By using Niyeo Services, you acknowledge that you have read, understood, and agree to be bound by this Intellectual Property Policy.
This Intellectual Property Policy ("Policy") governs the use of Niyeo Services, a platform offering search, chat, and Q&A functionality, provided by Apance Pte Ltd ("Niyeo," "we," "our," or "us"). By accessing or using Niyeo Services, you agree to comply with this Policy and our Terms of Service. This Policy is designed to protect intellectual property rights and outline the procedures for addressing potential infringements.
## Copyright Protection
Copyright is a form of intellectual property protection granted by United States law to original works of authorship, including literary, dramatic, musical, artistic, and certain other intellectual works. While copyright protects the expression of ideas, it does not extend to facts, ideas, systems, or methods of operation. Niyeo respects the copyrights of others and expects its users to do the same.
## Copyright Infringement Reporting
If you believe that your copyrighted work has been infringed upon within Niyeo Services, you may submit a notification of claimed infringement to our designated agent. Before submitting a formal report, we encourage you to attempt to resolve the issue directly with the user you believe is infringing your copyright.
## Trademark Protection
A trademark is any word, name, symbol, or device, or any combination thereof, used in commerce to identify and distinguish the goods or services of one provider from those of others. Trademark law in the United States aims to prevent consumer confusion regarding the source or sponsorship of goods or services. Niyeo respects the trademark rights of others and expects its users to do the same.
## Trademark Infringement Reporting
If you believe that your trademark has been infringed upon within Niyeo Services, you may submit a notification of claimed infringement to our designated agent. As with copyright claims, we encourage you to attempt to resolve the issue directly with the user you believe is infringing your trademark before submitting a formal report.
## Repeat Infringer Policy
Niyeo maintains a policy for addressing repeat infringers of intellectual property rights. In accordance with this policy, we may, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the intellectual property rights of others.
## Content Removal and Account Actions
In the event that we receive a valid intellectual property infringement claim, we may remove or disable access to the allegedly infringing content. We may also take appropriate action against the user's account, which may include suspension or termination, depending on the nature and frequency of the infringement.
## Counter-Notification and Reinstatement
If content has been removed from Niyeo Services due to an intellectual property infringement claim, and you believe the removal was in error or that you have the right to use the content, you may submit a counter-notification. Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us of legal action within a reasonable time, we may reinstate the removed content.
## Modifications to this Policy
Niyeo reserves the right to modify this Intellectual Property Policy at any time. We will notify users of any significant changes through appropriate channels. Your continued use of Niyeo Services following such modifications constitutes your acceptance of the revised Policy.
